Prior express written consent
The standard of permission required for certain marketing calls and texts to wireless numbers under the TCPA.
The FCC’s one-to-one consent rule, which would have required consent to a single identified seller at a time, was vacated by the Eleventh Circuit in January 2025 and subsequently repealed. The earlier standard applies, under which consent can cover multiple sellers if the disclosure is clear.
Why it matters to a broker
What protects you is the record, not the assurance. A vendor should be able to produce the consent language, the form as the merchant saw it, the timestamp, the IP and the URL for any record you ask about.
