Prior express written consent

Definition

The standard of permission required for certain marketing calls and texts to wireless numbers under the TCPA.

The FCC’s one-to-one consent rule, which would have required consent to a single identified seller at a time, was vacated by the Eleventh Circuit in January 2025 and subsequently repealed. The earlier standard applies, under which consent can cover multiple sellers if the disclosure is clear.
